A very spacious living area, decorated to make you feel like you are back in time. This unit offers a large kitchen furnished with everything you will need, a laundry room with a full-sized washer and dryer, and Wi-Fi for your convenience. The back deck area is perfect for enjoying the sounds of nature and viewing our magnificent mountains. No Smoking. Absolutely NO Pets from December through March. Pet-friendly may be available seasonally. There are pet size/breed and number restrictions please confirm with us before booking. Please acknowledge that there is a $100 pet fee(per pet). No Check-in's Thanksgiving Day or Christmas Day. All guests are required to sign their rental agreement within 7 days of booking.

Cancellation Policy

Your reservation may be canceled if it is 31 days or more before your scheduled arrival date. Monies will be refunded less a $50 cancellation fee on all rentals under $2000 and less a $500 cancellation fee on all rentals of $2000 and over. lf unit is re-rented for full time of canceled reservation on a $2000 or more reservation, then the cancellation fee will be reduced to S50. * lf the requested cancellation is within 30 days of scheduled arrival date, no monies can be refunded unless property is re-rented for the full time period of canceled reservations. lf the property is re-rented for the full time period of canceled reservation, client will be refunded in full less a $50 cancellation fee. lf unit is only re-rented for a portion of the canceled reservation, client will only be refunded the amount of days the unit was re-rented. Renter of canceled reservation will be refunded damage waiver fee or security deposit, cleaning and linen fee, the prorated rent for the time period, and all taxes on the prorated rent. ln the event that a renter must cancel their reservation, said cancellation must be done in writing. Booking Policy

To confirm your reservation a signed rental agreement and advance rent payment (50% of total) must be returned to Resort Real Estate & Rentals at Sugar Mountain (hereinafter referred to as RRR) within 7 days of making the reservation. The balance of payment is due 30 days prior to arrival. Payments may be made by credit card, personal check, money order or certified funds. No personal checks will be accepted within 15 days of check-in. Payment in full is required on reservations made within 30 days of arrival. Major credit cards accepted with the exception of American Express. Prices could be subject to change until a signed contract is in our possession and deposit received. $35 fee on all returned checks. This is a vacation rental agreement under the North Carolina Vacation Rental Act. The rights and obligations of the parties to this agreement are defined by law and include unique provisions permitting the disbursement of rent prior to tenancy and expedited eviction of tenants. Your signature on this agreement, or payment of money, or taking possession of the property after receipt of this agreement is evidence of your acceptance of the agreement and your intent to use this property for a vacation rental. Rentals exceeding 90 days do not fall under the NC vacation rental management act and are not subject to the same protections adhered to by the NC Vacation Rental Management Act. All monies collected in relation to the rental property herein above described will be placed in an interest-bearing trust account at Highlands Union Bank, 115 Main Street, Banner Elk, NC 28604. These monies shall include, but not limited to: holding deposits, rents, security deposits, linen and damage deposits. All interest accrued in this account shall accrue to RRR. Maximum occupancy must be strictly adhered to. Occupancy count includes children. Exceeding the occupancy limit set for your unit is ground for immediate eviction. No exceptions and no refunds! Accidental Damage Protector & Security Deposits: The Accidental Damage Protection PIan is included in the advertised total amount and indemnifies you and your family up to $1500 for any accidental damage during your stay. All accidental damage must be reported to our office by the renter immediately upon occurrence of damage in order for Damage Protector to apply. Reporting upon checkout or after will result in extra charges. Damage Protector is a surety contract and is not insurance. RRR is not an insurer, insurance agent or underwriter. The Accidental Damage Protection is non-refundable. Damage Protector does NOT cover intentional damage, excessive cleaning, theft, Acts of God, gross negligence, pet damage, utilities, rent, pay for view cable charges, additional costs incurred during stay per renters request, or loss of use. Any intentional property damage or items listed above will be billed to the renter and may be charged to renters account or credit card on file without renters consent if RRR is unable to contact renter to request authorization. Signature: A security deposit can be elected in lieu of Accidental Damage Protection. The cost ranges from $200 to $800 depending on the rental unit. It is fully refundable by mail within 30 days of departure providing no damages have been made to the unit and the unit has been left tidy (according to our check out procedures) or (less any allowable deductions). The security deposit can be paid in advance by personal check, money order, certified funds or credit card. Security deposits paid upon arrival must be paid by cash or credit card only. RRR retains the right to charge a renter a security deposit and not the Accidental Damage Protector. A few homes may require an additional security deposit beyond what is required above in this rental agreement. The renter agrees to reimburse the homeowner for any damages to the property caused by renter that are in excess of, or not covered by Damage Protector or the security deposit. Such damages shall include reasonable attorney fees and court costs. The provisions of Article 5, Chapter 42A of the North Carolina General Statutes (Landlord and tenant Duties) are incorporated herein by reference as if fully set forth. The renter fully understands that RRR is a rental agency engaging in the rental of private property of others. RRR reserves the right to refuse service to anyone RRR feels will not be responsible for the property he/she is renting. RRR does not rent to anyone under the age of 21. Each rental unit requires a person 21 or older to rent and sign the rental contract. This person must be present at check-in and for duration of rental. Renter understands that RRR has the right to terminate this agreement, re-enter the unit, or take necessary measures to remove the renter from the premises in the event renter and guests violates the conditions of this agreement. RRR is not responsible for the loss or theft of clothing, money, jewelry, etc. and is not be held liable for any accidents or injury of any nature. RRR reserves the right to move any reservation that might come about due to unforeseen circumstances (house sold, out of rental program, owner's use, act of God, etc.) Under no circumstances is the obligation of RRR more than that of refunding the renters deposit. Rates are subject to all applicable taxes. Rates are subject to change with notice Accommodations: All of our vacation properties are individually owned and reflect each owner's taste. Rearranging of furniture is not permitted. lf you have specific standards or requirements for your vacation residence we advise personal inspection of the property prior to making reservations. Do not use nails, screws or permanent adhesive to any surfaces. Burning wood or any foreign objects in any gas fireplace is prohibited and subject to forfeiture of security deposit. Grilling is not permitted on any porches, decks or walkways. All units are provided with enough garbage bags, paper towels, dishwashing detergent, bath soap, and toilet paper to get you started. lf you need more of these items, you can purchase them at Food Lion located on Tynecastle Hwy or other local grocery stores. Firewood is NOT provided. Propane/grill accessories are NOT provided. A one-time linen fee is charged on all units. Linens are provided with initial set-up. Additional linens/towels are not provided. Towels for pools and/or hot tubs are not provided. There is a fee for extra linens and linen exchanges. Renter agrees to indemnify and hold harmless RRR and the owner from and against any liability for personal injury or property damage sustained by any person (including renter's guests) as a result of any cause, unless caused by the negligent or willful act of RRR or the owner, or the failure of RRR or the owner to comply with the Vacation Rental Act. Renter agrees that RRR, the owner or their respective representatives may enter the premises during reasonable hours to inspect the premises, to make such repairs, alterations or improvements thereto as RRR or owner may deem appropriate, or to show the premises to perspective purchasers or renters. RRR does not guarantee any weather, road or ski conditions and there will be no refund as a result of either. Transportation is the sole responsibility of the renter. Snow tires, chains or 4-wheel drive is mandatory during adverse weather as stated by Sugar Mountain law. Travel Insurance: Travel insurance is automatically added to the first advance rent payment amount due. We offer travel insurance through Red Sky Travel Insurance. To decline coverage sign where indicated and deduct the insurance amount when making your payment. We encourage you to protect your vacation investment by including travel insurance with your deposit. This provides coverage should you need to cancel or interrupt your trip as well as primary medical coverage, coverage for lack to snow and much more. Please read your "Description of Coverage" for details. lf no computer access, please ask us to send you a copy of the insurance Policy or call Red Sky at Website: . Insurance premiums are non-refundable. Check-ln: Check in starts at 4:00 pm. RRR does not guarantee check-in time. Check in at our office 3390 Tynecastle Hwy (Hwy 184). No early check-ins are guaranteed. Renters are not permitted to enter the unit without first coming to the office and checking in. Renters may be required to show lD. No entry is allowed until units are cleaned and inspected. There is a refundable $5.00 per key deposit (cash only) due at check-in. There is also a refundable $45.00 deposit on community gate remotes where applicable (cash or credit card only). Our office hours are from 8:30 a.m. to 5:30 p.m. Monday through Friday and 5 p.m. on Saturdays with extended hours during ski season (including Sundays). lf you will be arriving after regular office hours there will be a late arrival packet left for you in the green "Check-in" box at the front of our office. This is provided if you have paid in full and have a signed contract. The packet will have your name on the front and inside you will find a map to the unit(s), one key, and emergency phone numbers in case of a problem. NO arrivals on Thanksgiving or Christmas Day as our offices are closed. Upon check in, if you have any housekeeping issues or other issues related to the comfort of your stay. please contact our office immediately to report specifics. There will be no refunds upon checkout for issues that were never reported immediately upon check-in or during your stay. Check-out: 10:00 a.m. All units must be vacated by 10:00 a.m. on the scheduled departure date and keys returned to office unless PRIOR arrangements have been made for late check-out. Failure to check out on time will result in a S50 late checkout fee. Failure to comply with check out procedures listed below will result in additional charges. Before checking out please do the following steps: 1. Tidy Unit 2. Load and start dishwasher 3. Clean out refrigerator - do not leave any food in kitchen 4. Take out all trash to appropriate receptacles (trash MUST be bagged) 5. Turn off all lights 6. Unplug small appliances 7. Turn thermostats (heat) back to 55 degrees in winter 8. Lock and secure all windows and doors Ordinances: Most properties limit number of vehicles and parking spaces. Parking is not permitted on town streets. Renter is responsible for any fees incurred due to parking in prohibited areas. No oversized vehicles are allowed in parking areas without prior permission from RRR. Buses and oversized vehicles are prohibited on the mountain except in designated areas. Town ordinance prohibits loose dogs on the mountain. All dogs must be kept on a leash. Quiet Hours are from 11 p.m. to 8 a.m. on Sugar Mountain. After one notice, if tenant fails to adhere to this regulation it will result in an immediate eviction and forfeiture of all monies paid Daily Maid Service: is not provided. We can, however, arrange extra cleaning services for you at an additional charge. Must have 48 hours advance notice. Lock Out Policy: During office hours you may pick up an extra key at our office. After hours, one of our agents will meet you at the office. There is a $25 charge for this service. Locked Closets: Most units have one or more locked closets which are not available to guests. These doors are checked behind each guest. Tenant will be responsible for any damage or missing items. Criminal charges could result. Repairs and Service Calls: Please report any inoperative equipment to our office promptly. We cannot guarantee appliances, TV's, heaters, gas logs, cable or internet, etc. and no refund or rate adjustments will be made for any mechanical failure including power outages. We do not refund for malfunctioning hot tubs. We will, however, make every effort to have repairs done quickly or reasonably remedy the problem. Telephones: Most units have telephones. Some are set up for 911 services only. Please charge all long distance calls to your credit card, calling card, or home phone. There will be an additional $10.00 service charge on any calls charged to the unit phone number. Local prefixes 898, 733, 737,387 and 964 only. All others are long distance including Foscoe, Boone and Blowing Rock. Pets: Absolutely NO pets are allowed unless otherwise permitted by RRR. You must call for permission. A pet deposit of $100 per pet is mandatory and is not refundable. Breach of this policy will result in immediate eviction and loss of monies. No pets are allowed between December 1st and March 15th. Smoking: Absolutely no smoking in units. Failure to adhere will result in a fumigation charge and immediate eviction. Waiver of liability for Spa, Hot Tub, Jacuzzi, Sauna and Pool: The renter understands that there are special risks involved in the use of above special features. Renter is aware there are potential dangers these features may present to children and adults that are not carefully supervised, as well as any person using special feature too long or if a person has health risks or is intoxicated or using any kind of drugs or medication, or pregnant. Renter agrees to waive any claim whatsoever against RRR and owner of property for accidents or injury arising from use of special features. The renter agrees he/she is responsible and liable for any damages that occur to the special feature through his or his guest's misuse or negligence. lf a hot tub has to be drained and refilled due to foreign substances in the water, there will be an extra charge to the renter for this service and it will be charged to renters account or credit card. Units listed for Sale: Renter agrees to allow unit to be shown promptly. 24 hour notice will be given. Property Transfer: ln the event the Owner transfers this property prior to occupancy by renter, renter has the right to enforce this agreement if the rental is to end 180 days or less after the transfer of ownership. lf more than the above 180 days, renter has no enforcement rights unless the Grantee agrees to honor this rental; however, renter has a right to a refund of all monies paid. RRR will promptly notify renter if property is transferred. Mail: We do not accept mail for renters renting less than one month. lf renting for a month or more mail may be forwarded to 3390 Tynecastle Hwy Banner Elk NC 28604. Mail will be picked up daily and will be available at our office after 2 p.m. if possible. RRR is not personally responsible or liable for any lost or damaged mail. lllegal Acts: Absolutely no acts illegal by law are allowed in RRR units or on premises.
